Accused child molester takes plea deal

Former Alameda County sheriff was accused of molesting three children

A former Alameda County Sheriff's deputy pleaded guilty to three felony counts of child endangerment on Monday after being arrested in November 2010.

Michael Bareno, a 43-year-old San Ramon resident, molested three children between 2005 and 2009 in San Ramon. Bareno accepted a plea deal and was sentenced to one year in jail, with credit for 199 days already served, and five years on probation.

Alameda County Sheriff's Sgt. J.D. Nelson confirmed that Bareno had worked as a deputy at the Santa Rita Jail and had been with the sheriff's office for at least 10 years. Upon his arrest, Bareno was placed on paid administrative leave until his resignation several weeks ago.

While Bareno is not required to register as a sex offender, he must pay for any counseling his victims require and cannot object to a permanent restraining order during the term of his probation.

Prosecutor Paul Graves declined to comment on the case outside of court.

I can't even begin to express how angry this makes me. He molested THREE CHILDREN (that we know of, so far) and he gets ONE YEAR in the county jail, with credit for 199 days already served WHILE ON PAID ADMINISTRATIVE LEAVE from his job as a SHERIFF'S DEPUTY? Taxpayers paid him to SERVE AND PROTECT, he should be held to a higher standard, not offered a plea deal that gets him out of having to register as a sex offender.

'Twould seem that either his lawyer was Clarence flippin' Darrow, or there must have been some serious flaws in the prosecution's case.

Anybody have any actual facts?

Please find out WHY he doesn't have to register as a sex offender. It seems the world and this whole county and more specifically, this state has gone mad.

Wonder if things would be different if Bareno had not been with law enforcement? One of his victims was under ten years old, and this scumbag was not just flashing kids either - it was far more serious.
Paul Graves - you are worthless as a prosecutor. Ditto for the judge. Both of you should be flipping burgers. I hope next time Bareno goes after one of your kids Graves. Not a wonder you couldn't be reached for comment. You are a sad joke.
People still get longer sentences for selling prescription drugs.
Oh, and just curious - is Bareno now prohibited from carrying firearms?

Because of the plea, he was convicted only of "felony child endangerment," which is why he doesn't have to register as a sex offender. In another article I read, the prosecutor cited the victims' ages (all under 10) as at least part of the reason for offering the deal. I've discovered that the judge did ask the children's mother if she objected to the deal, to which she replied "We accept the plea bargain because we believe it's in the best interests of the children to move forward." As a survivor, I think I can speak for the children that it would be in their best interests to nail the b*st*rd's wee bits to a tree.
