Loyalty Oaths: Code of Conduct contracts in schools and school leagues

Dear Dolores,

The current feature provided in subscriber reader services on school and school league use of loyalty oaths as code of conduct contracts has been published yesterday in the corridor subscriber news service using news and legal research sources. Reportedly the feature will appear in Yahoo News next week? The research included a review guide for parents of students considering extracurricular participation including modification and attachments for defining school district reach and authority.

In the legal review of code of conduct contracts as part of the overall loyalty oath case law history, legal correspondents noted the civil rights violations imposed on students as minors. Further, such contracts effectively between parents, districts and leagues imply jurisdiction beyond campus and school-managed activities that reaches beyond State laws governing school districts' authority.

What appears to be the next step for parents is a test case event where a student is impacted by the code of conduct terms and conditions beyond the campus and school-managed activities. If a student is 1) refused participation in extracurricular activities due to refusal to sign or modification of the code of conduct contract, or 2) is punished for events beyond campus and school managed events, resident counsels will pursue a test case to define code of conduct limits and the liability of administrators, coaches and other school/league personnel.
