Before you leap to a conclusion ask yourself, if the roles were reversed would he kill you?
As to the 2nd question I believe the term is "collateral damage!"

Or you could ask yourself, "What would Jesus do? I believe he said, "Do unto others before they do unto you." Or something like that.
