A Contra Costa County judge has postponed the hearing of a Danville teen accused of rape to consider his plea deal, according to the district attorney. Sam Nesis, a San Ramon Valley High grad, allegedly raped a 14-year-old girl in his van this February.
Prosecutors have charged Nesis, 19, with forcible rape, forcible oral copulation of a minor age 14 or older and three related felony sexual offenses for an attack authorities said occurred in Nesis’ blue 1977 Chevy 1500 van the night between Feb. 18 and 19.
“The plea agreement was…oral copulation with an intoxicated person. It would have been three years in state prison and lifetime registration as a sex offender,” said Deputy District Attorney Derek Butts. The agreement would include other terms and conditions such as restitution.
However, comments from Nesis’ victim and a questionable probation report compelled Judge Clare Maier to postpone a decision on the plea deal until Dec. 1. If Maier declines the plea deal, the district attorney and prosecution will either renegotiate the terms of Nesis’ plea or set a date for a preliminary hearing and proceed with new negotiations.
Nesis’ attorney, Lisa Robinson, declined to comment on the case or Wednesday’s hearing.
The case was investigated by the CHP as the incident is said to have begun as the defendant and victim were traveling on a freeway, and continued in the parking lot at the Walnut Creek BART station. The girl reported the assault and was treated at a hospital early Feb. 19.

What the press doesn’t tell you is that this girl came on to sammy and wanted to “hook up” with him. Sammy should be a free man, This girl and her family have taken the life of a good harmless man. “Sammy was an amazing guy” …. past tense? That alone speaks volumes. All rapists blame their victims. He is a perp of more than 1 sexual assault. That makes him a predator. Why was this “great guy” so ready to make a plea deal to admission of guilt and a prison term? Maybe he doesn’t want the truth to come out! I agree with the victim and her family …3 years is not long enough for this animal.

You have got to be kidding with “Sammy was an amazing kid that has run into a terrible turn of events!” Even if the girl had been willing, it is statutory rape which any guy knows. The fact that this was forced, he should be locked up and the key thrown away! He is by no means a, “good harmless man.” If you are a female, sammys great friend, I hope you never find yourself in any kind of situation like this.
