Discovery Bay Recall proponents caught Trespassing

Don Flint, head proponent of the Recall doesn't believe he has to follow the law.

The picture clearly shows Carol Jackson, a Brentwood gadfly, holding a petition ballot. A clear violation of Recall code.

“The recall petition can be circulated only by registered voters in the jurisdiction who are qualified to vote for the officer sought to be recalled. ” (§§322, 11045)

Since these people have invaded this site, thought I would share this with you all.

How can you see anyone holding anything in this picture let alone a recall petition? Your link and your statements clearly show your a child that's like "I'm telling Dad". Informed must be your playmate. The website you link to is just like a child's website too with all the name calling. I'm surprised this professional news media would allow such a bias garbage website link to degrade their integrity.

If no one was arrested there was no trespassing. This all sounds like someone is trying to circumvent the democratic process in fear that it will work properly.

Is Supervisor Mary Piepho aware of this circumvention of the democratic process?

@ Hypocrit, that could do down as one of the dumbest defenses on record. Because no one was arrested, no crime took place? That's your logic?

The fact that East County has scarce police resources and would tie up 2 Deputies to transport these people to Martinez for booking didn't occur to you? For a misdemeanor crime?

Which part of intentionally ignoring the requests of the tenant and property owners by trespassing was the "democratic process" part? Which part of having ineligible signature gathering activities taking place was the "democratic process"?

That isn't the way it works in the America I know. Are you new here?

What does Mary Piepho have to do with you choosing to violate election laws or trespass with your recall deal? Did you not bother to read the laws guiding recalls before engaging in one?

That’s like comparing it to David Piepho taking $7,000 in public funds illegally and the Sheriff couldn't transport him so he got away. You’ve got to be kidding.

What part of two letters from attorneys outlining to David Piepho the stipends he was allowed, then he ignored those letters and did it anyway. Because he gave the money back it's O.K. ?

Talking about groups circumventing the democratic process ? Your group is so shady as informer’s group it’s scary.

Looks like someone's feeling a little guilty because you decided to completely change the subject. To get the heat off of you, you trot out one of your old lies about stipends.

Comments right from legal counsel John Stovall that night of Dec 12, 2009:

"He found that they were mistakenly paid for meetings..."

"He did not find any meetings that were not associated with the town.."

"He found that the mistake of over payments were made due to the complexity of the issue, the press of other business, and internal accounting procedure..."

For a kicker, the legal firm gave the town a $12k credit for services the following year because of their oversight. So again your smear merchant group who likes to rewrite history does a massive FAIL in telling the truth.

Back on topic, why did your group pack up and go from Safeway? You insist you were within your rights. You said you have widespread community support and told The Press 6 weeks ago you had your signatures for your recall.

This pathological lying thing been a problem for you for very long?

Why can't you keep your dirty laundry in your own back yard? I don't think the people of Danville really care to read it.

Is that your new pseudonym for the week? Have you added that to your growing list? After all, you have posted under vote, voter voter2, voter5, voter 2012, vote3333, and a few others in just the last 30 days.

You see, once again you slipped up and added a space before ending your sentence’s with a “?”. That and your IP is a dead giveaway. You made your error 4 times in your last post. In case you still have not figured it out you don’t need to put a space before a question mark.

I have nothing against posting under an anonymous pseudonym-I do it myself, but doing it under multiple different names just comes across as a desperate attempt…hoping that someone might think more people share your distorted points of view? Sorry but judging by the posting above (by Flint’s Shadow and others) it still is not working.

Once again I followed up and you are back to your same games of innuendo and deceit. I guess it has not dawned on you that while the computer age lends itself to blogging and despicable mudslinging it also adds to the ability to easily do research and follow up on accusations made by you.

I’m not sure what is going on with you and your little cabal, but your frustration is coming across in volumes and you are simply exposing yourselves. Are you really hoping to snag casual readers into believing your deception by posting inaccuracies? You know the saying about fooling some of the people some of the time…you are certainly a textbook example of that.

I thought you would have learned your lesson last time around……

For someone that “claims” they don’t do blogs, you sure are proving yourself to quite the opposite.
You see, most people do not put a SPACE between their sentence and a question mark or exclamation point… You might want to stop doing that-because it is a dead giveaway.

If you want to talk about crime in Discovery Bay, let's do that.
Lets expand on this illegal taking of $ 7,000. of the people's money by Director David Piepho. You seem to have a problem as others in your group what exactly constitutes a crime. Just because you say some minutes say anything, does not mean a crime did not occur. The fact that two official letters were sent to Mr. Piepho by an attorney outlining what was eligible and what was not eligible prior is very damaging. Just the fact that a formal request for money from him for ineligible public funds after the two letters from legal counsel shows intent to defraud. Moreover, when caught the money was returned too fast showing even more guilt. If he truly thought he was entitled to those thousands of dollars he would have disputed it. I am quite surprised that the District Attorney has yet to file formal charges. Someone still may file charges.
Talk to Barefoot about dirty laundry. Barefoot, yourself, informed psychotic have brought your own dirty laundry to Danville.

@ RCV, that's a rather unhinged response there.

Sorry, but I followed the stipends thing to include speaking with an outside attorney licensed to practice municipal law. The stipends were entirely defensible. The town just didn't feel like going there, especially after some old senile guy wasted over $100k in a legal witch hunt that went nowhere just a couple years earlier. Was that you, maybe?

We can sit here and jawbone on this till hell freezes over. You know what they say about opinions. The only one that counts here is what comes at the end of a Judge's ruling.

You're wrong about a formal request. Piepho returned the money before anyone asked. I know you fellas like to think it was just a greedy scam, but apparently you don't know the guy too well. It's not like he needed the money.

The DA didn't see any wrong doing and didn't pursue it, so I guess you don't have many fans for your viewpoint. At least not fans that count.

But hey, to play fair let's go with your suggestion. Just because you and your buddies didn't get arrested @ Safeway, let's not assume a crime didn't occur. I'm good with your approach on that.

The overarch here are the overly aggressive petition circulaters who have forced the hands of corporations. This goes back to last year and even before, prompting Safeway and others like Costco, Home Depot and Target to prohibit such campaigns on their sites. Too controversial and just bad business.

I know I don't care to be approached for signatures when I go to a store. I'm there for a sole purpose, typically, and many times have been made uncomfortable by these folks. I seem to remember there have been a few of these instances in Contra Costa County in general.

Flint's claim that Dawson's supporters were responsible only underlines his myopic view of what took place.

The complete disregard for the advance heads up from Safeway's legal group is an eyebrow raiser that screams desperation on Flint's part.

Anyone who wants to know the real truth about the Safeway mock just contact the Sheriff's Office 646-2441 or ask the Deputy who attended the last meeting and reported to the DBCSD.
The Deputy publically spoke and stated " THERE WAS NOW TRESPASSING "
Even after stipend stealing David Piepho tried to change the Deputy's mind. THERE WAS NO TRESPASSING. Don't take my word for it, listen to the recording of the public meeting when the Deputy explained there was no trespassing. Go to and listen.
The comments and lies by Barefoot, Informed, Shadow, Bob, David, Tim, and other Piepho intimidators is becoming more problematic for the Town. You guys are making Discovery Bay the laughing stock of the county. If the people want to keep Dawson they will. Stop being a bunch of babies.

“Hypocrite”, you sure are making the rounds. Well, if your name doesn’t say it all, your postings sure do. You might want to calm down a bit.

I imagine that the Sheriff was trying to play “peace maker”, but if that is too difficult for you to comprehend, the question remains; why did two Sheriffs show up on that fateful day, and kick out the violators? It clearly appears Safeway issued an order of trespass. More importantly why are YOU posting links to certain recall proponents sites if you are not one of them?

I read the online story today on the front page of the paper-it contradicts everything you say. So if you want me (or anyone else) to believe you, then we would all have to assume that the reporter was lying. You would have us believe that spokesperson for Safeway, their legal team, and lawyers were also lying? Sorry, but you are outranked and outnumbered.

You might want to re-read it for yourself;

• …supporters of the effort to recall CSD Director Brian Dawson were evicted from the Discovery Bay Safeway parking lot.
• “We did call the police and they handed a trespass notice to the solicitor and they were instructed to leave,” said Susan Houghton, director of public relations for Safeway.
• “I had personally sent an e-mail on Friday (Jan. 27) to Mr. (Don) Flint, and our legal team and legal counsel did as well. Mr. Flint’s response was that he disagreed.”
• “Petitioners are never acceptable,…”
• Houghton said that “repeated complaints” from customers of harassment by petitioners led the local store manager to contact corporate headquarters, where the violation of the solicitation policy was discovered.

p.s. If you haven’t noticed you and your little group have just exposed yourselves. There will be more to come I’m sure.

Unbelievable that Don Flint and his crew started posting to a blog outside the Discovery Bay community to try to get someone to care about his ridiculous recall effort. Just goes to show how little support he's got in Discovery Bay, and of course how pathetic and desperate he is to get attention.

Dear Editor,

To complete this story, Brian Dawson resigned this morning, February 6, so the community of Discovery Bay could come together for the good of all residents. Brian and his family need their privacy and support of friends to move forward with their lives. Within the next 60 days there will be a decision on an election or appointment to replace Brian on the DB-CSD.
